Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WAAI service. By using the service, you agree to these Terms. If you do not agree, please do not use the service.

1. Service Description

WAAI provides a platform for creating and managing an AI agent that communicates with business customers via WhatsApp and website. The service includes automated response handling, order processing, conversation management, and integration with business workflows.

2. Registration and Account

Using the service requires registration via Google OAuth.
You are responsible for the security of your account and all actions taken through it.
You agree to provide accurate and up-to-date information upon registration.

3. Acceptable Use

You agree to use the service only for lawful purposes. The following are prohibited:

Sending spam, fraudulent, or misleading messages through the AI agent.
Violating Meta's WhatsApp Business API Terms of Service.
Using the service to collect personal data without user consent.
Attempting to hack, reverse-engineer, or circumvent security systems.
Reselling or sublicensing access to the service without WAAI's written consent.

4. Subscription and Payment

The service is provided on a subscription basis (monthly or annual).
Payment is charged automatically at the beginning of each billing period.
You may cancel at any time; access continues until the end of the paid period.
Refunds for unused periods are not provided, except as required by law.
We reserve the right to change pricing with 30 days' notice.

5. Intellectual Property

All rights to the WAAI platform, its design, code, algorithms, and content belong to WAAI. Using the service does not transfer any intellectual property rights to you.

Content you upload (service descriptions, price lists, materials) remains your property. You grant WAAI a limited license to use it solely for the purpose of providing the service.

6. Data Privacy

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

7. Limitation of Liability

The service is provided "as is". WAAI is not liable for:

Temporary service unavailability due to circumstances beyond WAAI's control.
AI agent responses that do not meet user expectations.
Losses arising from your violation of these Terms.
Failures of third-party services (Meta WhatsApp API, AI model providers).

In any case, WAAI's total liability shall not exceed the amount paid by you in the last 1 month of subscription.

8. Suspension and Termination

WAAI may suspend or terminate your access to the service without prior notice in cases of violation of these Terms, fraudulent activity, or regulatory requirements. Upon termination, you may request an export of your data within 30 days.

9. Changes to Terms

We may update these Terms. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of the service after the notice constitutes your acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of the State of Israel. All disputes shall be resolved in the competent courts at WAAI's place of incorporation.
